Rise of the Machines: The Growing Role of Artificial Intelligence in Discovery

As artificial intelligence increases its share of the everyday workload of employees, legal discovery about artificial intelligence is becoming more frequent. Discovery requests about queries, inputs,
and outputs; usage of artificial intelligence to evaluate productions; and depositions focused on the role of artificial intelligence in an organization may soon move from “cutting edge” to “commonplace.” With this rise in such discovery activities, organizations
must begin to think about their preservation obligations, their ability to meet such discovery demands, and the protections needed for any information or materials they produce. This presentation will explore the trends in discovery about artificial intelligence
and the actions organizations should take to meet these new requirements and to safeguard their most important trade secrets.
